Third Circuit Rejects ERISA Challenge to MetLife’s Use of Drug Rebates

Plaintiffs failed to show a financial injury to support standing under the Employee Retirement Income Security Act (ERISA) in an action against their former employer MetLife Group, Inc. alleging it improperly diverted drug rebates from their health plan causing them to pay higher out-of-pocket costs, the Third Circuit held September 25.
