First Circuit to Review Causation Standard for False Claims Allegations in Kickback Action

The First Circuit agreed December 11 to review the causation standard in a False Claims Act (FCA) lawsuit brought by the federal government alleging Regeneron Pharmaceuticals, Inc. violated the Anti-Kickback Statute (AKS) by improperly funneling millions of dollars to a Chronic Disease Fund (CDF) to subsidize patient copays for its drug Eylea.
