U.S. Court in Pennsylvania Refuses to Enjoin FTC Rule Banning Worker Noncompetes

A federal court in Pennsylvania refused July 23 to preliminarily enjoin the Federal Trade Commission’s (FTC’s) final rule that bans nearly all noncompete clauses in employment agreements. The ruling comes after a federal district court in Texas earlier this month reached the opposite conclusion, granting a preliminary injunction and finding the Commission likely lacked rulemaking authority to block noncompetes as an unfair method of competition.
