U.S. Supreme Court Won’t Review Decision Upholding FCA Liability for Home Health Care Kickback Scheme

The U.S. Supreme Court declined October 15 to review a Seventh Circuit decision finding that three home health care companies and their owner violated the False Claims Act (FCA) and Anti-Kickback Statute (AKS) by paying to “data mine” a referral source’s patient records to solicit potential business.
