Second Circuit Refuses to Revive Physician’s FCA Retaliation Action

The Second Circuit declined June 18 to revive a physician’s action for unlawful retaliation under the False Claims Act (FCA) and New York law alleging she was fired for objecting to “upcoding” billing practices that she viewed as fraudulent to Medicare and Medicaid.
