U.S. Court in Florida Dismisses State’s Challenge to CMS Guidance to Prevent CHIP Coverage Terminations for Nonpayment of Premiums

The U.S. District Court for the Middle District of Florida recently dismissed Florida's challenge to Centers for Medicare & Medicaid Services (CMS) guidance indicating that states could not terminate Children’s Health Insurance Program (CHIP) coverage for nonpayment of premiums during continuous eligibility. The state alleged the guidance violates the Administrative Procedure Act (APA) and can only be issued through notice-and-comment rulemaking.
