U.S. Court in Massachusetts Says Medical Device Maker Must Face Whistleblower Action Alleging Kickback Scheme

A federal district court in Massachusetts refused August 2 to dismiss a qui tam action against Zimmer Biomet Holdings, Inc., which manufacturers orthopedic, medical, and surgical devices, alleging the compensation structure for its independent contractor sales force violated the Anti-Kickback Statute (AKS) and resulted in the submission of false claims.
