The Fifth Circuit declined August 15 to review a decision refusing to dismiss the Federal Trade Commission’s (FTC’s) lawsuit alleging U.S. Anesthesia Partners, Inc. (USAP) engaged in a multi-year “roll-up” scheme to consolidate and monopolize the hospital anesthesiology market in Texas.
