Ninth Circuit Revives EMTALA Screening Claim Alleging Hospital Failed to Examine Overdose Patient

The Ninth Circuit reversed July 23 the dismissal of an action under the Emergency Medical Treatment and Labor Act (EMTALA) alleging a California hospital failed to provide an appropriate medical screening examination to the plaintiff’s son who was brought to its emergency department (ED) by ambulance following an overdose.
