U.S. Court in Georgia Tosses Physician’s EMTALA Whistleblower Retaliation Claim Against Hospital

An emergency department (ED) physician could not move forward with a whistleblower retaliation claim under the Emergency Medical Treatment and Labor Act (EMTALA) against a hospital alleging he was fired for reporting violations of the statute because he was an independent contractor, not a hospital employee, a federal court in Georgia ruled February 5.
