Eighth Circuit Rejects Mental Health Parity Act Claim, But Upholds ERISA Disclosure Violation Penalty, Attorneys' Fees Award

Health plan administrator Microsoft Corp. and its claims administrator Premera Blue Cross shed a claim that they violated the Mental Health Parity and Addiction Act of 2008 (Parity Act) because plaintiff plan participants lacked standing as there was no injury fairly traceable to defendants’ use of certain guidelines for determining the appropriateness of care, the Eighth Circuit held October 1.
