Tenth Circuit Says Doctor Must Comply with DEA Subpoena

A divided Tenth Circuit held April 15 that a psychologist must comply with an administrative subpoena issued by the Drug Enforcement Administration (DEA). The appeals court found the subpoena—as narrowed by the lower court—complied with the Health Insurance Portability and Accountability Act (HIPAA) and didn’t violate the doctor’s Fourth or Fifth Amendment rights.
