Utah Federal Court Finds Plan’s Mental Health Coverage Denials Violated ERISA

The U.S. District Court for the District of Utah held that The Mueller Industries, Inc. Welfare Benefit Plan and its third-party administrator (TPA) violated the Employee Retirement Income Security Act’s (ERISA’s) requirement for a “meaningful dialogue” in denying coverage for a minor plaintiff’s residential mental health treatment. The court granted in part plaintiffs’ motion for summary judgment on this issue and remanded the benefits determination for further review.
