Ninth Circuit Rejects Hawaii Rules Mandating Sealing of All Medical and Health Records in Court Proceedings

Hawaii may not mandate the categorical sealing of all “medical and health records” filed in criminal or civil state court proceedings as a means of protecting the individual right to privacy guaranteed under the state’s constitution, the Ninth Circuit held August 28.
