Ninth Circuit Revives Health System’s Action Against Oregon Health Authority over Bed Space for Civilly Committed Patients

The Ninth Circuit reversed June 5 the dismissal of Legacy Health System’s action alleging Oregon Health Authority’s (OHA’s) failure to maintain adequate bed space for patients who are civilly committed for mental health illness. Legacy Health, which said the lack of bed space causes lengthy stays in its hospitals of civilly committed patients, asserted takings and due process claims.
