Third Circuit Revives Home Care Agencies’ Challenge to DOL Rule Nixing Overtime Exemption

Three home care companies will have another chance to pursue their challenge to a Department of Labor (DOL) rule that removed an exemption from federal overtime requirements for home care workers after the Third Circuit, citing the Supreme Court’s recent decision in Corner Post, Inc. v. Board of Governors of the Fed. Reserve Sys., 144 S. Ct. 2440 (2024), vacated the dismissal of the action as untimely.
