New Medicaid Rules Impacting Medicaid Managed Care

As we expected in our contribution to AHLA’s Top Ten Issues in Health Law 2024, the Centers for Medicare & Medicaid Services (CMS) has been moving quickly to finalize a number of rules that will impact Medicaid managed care entities (MCEs). The rules are notable for the speed in which they are being finalized; the minimal number of modifications made in response to comments; and a wide range of “applicability dates” as to when state Medicaid agencies and their contracted MCEs must comply, some as far as six years in the future.
