U.S. Court in Kansas Won’t Dismiss EMTALA Action Alleging Hospital Failed to Screen, Stabilize Pregnant Patient

The U.S. District Court for the District of Kansas refused January 13 to dismiss an action alleging a University of Kansas Hospital Authority facility violated the Emergency Medical Treatment and Labor Act (EMTALA) by failing to adequately screen and stabilize a patient who was 17 weeks pregnant and suffering premature rupture of membranes (PPROM).
