U.S. Court in Arizona Rejects Whistleblower Action Against Radiology Practice Alleging Violation of FDCA

On September 29, the U.S. District Court for the District of Arizona rejected a whistleblower action under the False Claims Act (FCA) alleging a radiology practice used “unapproved, inferior devices to provide diagnostic radiology services” while billing Medicare as “if it had used higher-priced, medical-grade equipment” in violation of the Food, Drug, and Cosmetic Act (FDCA).
