Supreme Court Upholds Government’s Dismissal of Whistleblower Action

The Supreme Court held June 16 that the federal government may seek dismissal of a False Claims Act (FCA) action over a relator’s objection so long as it intervenes at some point in the litigation. In an 8-1 decision written by Justice Kagan, the Court also held that district courts, in evaluating such motions, should apply the rule generally governing voluntary dismissal of suits in Fed. R. Civ. P. 41(a).
