Kansas Trial Court Temporarily Blocks State’s Telemedicine Abortion Ban

A Kansas trial court temporarily enjoined enforcement of a 2011 state law that prohibited physicians from prescribing abortion medications via telemedicine.
The court granted a preliminary injunction to Trust Women Foundation, according to the Center for Reproductive Rights, which filed the lawsuit in 2019 on behalf of the plaintiff.
The court initially denied the temporary injunction, but an appeals court panel reversed. The trial court on remand reinstated plaintiff’s claims against two state officials and temporarily barred enforcement of the law.
“This decision will further open up abortion care in Kansas at a time it’s urgently needed. In this post-Roe world, telemedicine can make the difference in being able to receive abortion care or not,” said Nancy Northup, President and CEO of the Center for Reproductive Rights.
Eighteen states currently have laws that prohibit the use of telemedicine for medication abortion, according to the Center for Reproductive Rights.
