Second Circuit Nixes Whistleblower Action Against Fresenius for Alleged Kickback Schemes

The Second Circuit affirmed December 20, 2022 the dismissal of a whistleblower action alleging Fresenius Medical Care Holdings, Inc. violated the Anti-Kickback Statute by paying above-market prices to acquire dialysis centers for physician owners to induce their referrals of patients to the newly acquired centers.
