U.S. Court in NY Says Physician Statements Protected Speech for First Amendment Retaliation Claim

Physician Mark Laftavi has sufficiently alleged that his statement to an ad hoc medical review committee in support of a colleague was protected speech for purposes of his First Amendment retaliation claim, the U.S. District Court for the Western District of New York held August 2. In so holding, the court denied the defendants’ motion to dismiss the claim.
