Virginia Appeals Court Rejects Informed Consent Claim Based on Potential Misdiagnosis

A trial court erred by allowing a plaintiff to proceed on an informed consent claim that was based in part on a physician’s failure to inform the patient about alternative treatments that would have been appropriate had he reached a different diagnosis, a Virginia appeals court held December 29.
