Eleventh Circuit Partially Revives Whistleblower Action Alleging Diabetic Testing Supplies Fraud

A whistleblower who brought an action against now-defunct Arriva Medical, LLC, Alere, Inc., and Abbott Laboratories sufficiently pleaded fraud with particularity for some of his claims that defendants improperly billed Medicare for diabetic testing supplies and other medical products, the Eleventh Circuit held December 20 in a per curiam opinion.
