While hospital merger enforcement was very active throughout the Trump administration, recent announcements augur an even more aggressive posture towards transactions in the health care space. New Federal Trade Commission (FTC) leadership indicate a continued focus on transactions affecting health care markets. In particular, the FTC’s announcement that it will conduct a retrospective study of consummated physician group and health care facility mergers signals a renewed focus on non-hospital provider transactions in particular.
