Cemex: The New Frontier or a Bump in the Road?

On November 2, 2023, the National Labor Relations Board’s (NLRB) General Counsel issued Memorandum GC 24-01 (GC Memo 24-01), latching on to the Board’s recent representation election-altering decision in Cemex Construction Materials Pacific, LLC, 372 NLRB No. 130 (2023), to advise regional offices across the country how to enforce the Board’s Cemex decision. GC Memo 24-01 makes clear that Cemex is a new tool and reminds regions that bargaining orders remain an option.
