Multi-State Lawsuit Challenges HHS Final Rule on ACA Nondiscrimination Protections

Fifteen states have joined a lawsuit challenging a recently issued Department of Health and Human Services (HHS) final rule spelling out that the Affordable Care Act’s (ACA’s) nondiscrimination prohibition in health care “on the basis of sex” includes “sexual orientation” and “gender identity.”
