OIG Says Ambulance Supplier May Bill Insurance and Waive Cost Sharing for “Treatment in Place” Services

Although a Proposed Arrangement to bill patients’ insurance plans—and waive any cost-sharing amounts—for treatment-in-place (TIP) emergency medical services (EMS) without an associated ambulance transport could generate prohibited remuneration under both the Anti-Kickback Statute (AKS) and the Beneficiary Inducements CMP, the Department of Health and Human Services Office of Inspector General (OIG) said in an advisory opinion posted November 25 that it would not impose administrative sanctions.
