Supreme Court Won’t Review Dismissed Kickback Allegations Raising Remuneration, Causation Questions

The Supreme Court declined October 2 to review a Sixth Circuit decision that embraced a narrow view of what constitutes remuneration under the Anti-Kickback Statute (AKS) and held that a relator must meet a more demanding “but for” causation standard in a False Claims Act (FCA) lawsuit based on alleged kickbacks.
