First Circuit Upholds Dismissal of ERISA Action Against Third-Party Administrator, Finds Fiduciary Status Lacking

Blue Cross Blue Shield of Massachusetts (BCBS) dodged April 25 an action brought against it under the Employee Retirement Income Security Act (ERISA) after the First Circuit agreed that BCBS, as a third-party administrator (TPA), wasn't a fiduciary of the plan at issue.
