Tennessee High Court Nixes TennCare Reimbursement Cap for Lack of Notice-and-Comment Rulemaking

A $50 reimbursement cap that Tennessee’s Medicaid program, TennCare, imposed on non-emergent care rendered by emergency-department physicians is a “rule” under the state’s administrative procedures act that should been subject to the notice-and-comment process, the Tennessee Supreme Court ruled May 25.
