U.S. Court in Missouri Says Hospital Must Face EMTALA Stabilization Claim

The U.S. District Court for the Eastern District of Missouri refused May 5 to dismiss a plaintiff’s claim that a hospital failed to stabilize his emergency medical condition prior to discharge. Although the court did dismiss plaintiff’s screening claim under the Emergency Medical Treatment and Labor Act of 1986 (EMTALA), the court found plaintiff presented sufficient evidence that his condition was not stabilized for that claim to survive at this stage of the litigation.
