U.S. Court in Michigan Tosses ERISA Action Against Third-Party Administrator Over Coverage Denials

A third-party administrator was not a fiduciary of a self-funded health plan and could not be sued under the Employee Retirement Income Security Act (ERISA) for denying coverage of a plan participant’s wilderness therapy and stay in a residential mental health treatment facility, a federal court in Michigan held May 22.
