Lab’s Proposal to Purchase Technical Component of Anatomic Pathology Services from Other Labs Could Trigger Sanctions, OIG Says

An anatomic pathology laboratory operator’s proposal to enter into agreements with other laboratories to perform the technical component of anatomic pathology services for commercially insured patients could violate the Anti-Kickback Statute (AKS) because it likely would result in referrals of federal health care program business to the requestor from the other labs, the Department of Health and Human Services Office of Inspector General (OIG) said in an Advisory Opinion posted September 28.
