Federal Circuit Rejects Former Relator’s Attempt to Recover Share of Subsequent FCA Settlement

The Federal Circuit affirmed June 6 the dismissal of a former relator’s attempts to recover a share of the government’s subsequent settlement with Amgen, Inc. The appeals court found the plaintiff’s Fifth Amendment takings claim and contract claims were time barred, and the U.S. Court of Federal Claims lacked jurisdiction over his remaining claims.
