OIG: Device Manufacturer’s Proposal to Provide Free Hearing Aid with Cochlear Implant Could Run Afoul of Fraud and Abuse Laws

A cochlear implant manufacturer’s proposal to provide a free compatible hearing aid to certain patients, including federal health care program beneficiaries, who receive one of its cochlear implants could trigger sanctions under both the Anti-Kickback Statute (AKS) and the Beneficiary Inducements CMP, the Department of Health and Human Services Office of Inspector General (OIG) said in an advisory opinion posted October 25.
