Second Circuit Revives FCA Retaliation Claims Against Home Health Provider

Two whistleblowers have another chance to show their home health company employer retaliated against them when they complained about its allegedly fraudulently billing practices under a Second Circuit summary order issued January 17. The appeals court also held relators should be allowed to amend their fraud claims to allege their lack of access to the company’s billing information.
