U.S. Supreme Court Won’t Review Physician’s Due Process Challenge to NPDB Reporting

The U.S. Supreme Court declined October 16 to review a constitutional challenge to the Health Care Quality Improvement Act and its implementing regulations for failing to provide physicians who are the subject of private hospital adverse action reports (AARs) to the National Practitioner Data Bank (NPDB) with due process.
