First Circuit Says ERISA Preempts State Law Wrongful Death Claim Against Blue Cross

The Employee Retirement Income Security Act (ERISA) preempts a state law wrongful death claim brought against Blue Cross and Blue Shield of Massachusetts (BCBS) for denying coverage of a particular inhaler for an insured who later died from asthma-related complications, the First Circuit held March 19.
