Supreme Court Asks Government to Weigh in on Challenge to Oklahoma PBM Law

The Supreme Court asked October 7 for the federal government’s views on a petition seeking review of a Tenth Circuit decision that found the Employee Retirement Income Security Act of 1974 (ERISA) preempted several provisions of an Oklahoma law regulating pharmacy benefit managers (PBMs). The Court invited the U.S. Solicitor General to file a brief on the matter.
