Nonprofit Fundraising Arms of Health Care Entities: Board Member Oversight and Legal Pitfalls

Many health care entities have philanthropic foundations with varying levels of oversight by the health care entity board. Whether the foundation is organized as a department of the health care entity, a separate 501(c)(3), or a 509(a)(3), the entity health care board has a role to play. Health care board members are accustomed to overseeing hospitals, developing policy, and making strategic decisions related to the future of the health care entity. However, many board members are not as familiar with their role as it relates to philanthropic efforts.
