Relator Omni Healthcare Inc. failed November 12 to revive a qui tam action alleging U.S. Oncology harvested overfill from oncology drugs and billed the government knowing the practice was illegal after the Second Circuit affirmed the lower court’s dismissal of the amended complaint.
