U.S. Court in Tennessee Holds Negligence Action Against Nursing Home Must Be Arbitrated

A federal district court in Tennessee held November 4 that a negligence action against a nursing home brought by the family of a resident who died after falling while under the facility’s care must go to arbitration pursuant to an agreement signed during the admissions process that the resident’s son-in-law signed as one of her two designated agents under a general durable power of attorney (POA).
