Second Circuit Affirms Dismissal of Whistleblower Action Against Pharmacies for Lack of Materiality

The Second Circuit refused March 15 to revive a whistleblower action brought by pharmacist Keven Askari against several pharmacies including PharMerica Corp. alleging they engaged in schemes that resulted in the submission of false claims for prescription drugs to Medicare and Medicaid.
