Tenth Circuit Upholds Ruling Against United over Denial of Residential Treatment Coverage

United Behavioral Health (United) lost its bid to overturn a lower court decision holding that it violated the Employee Retirement Income Security Act (ERISA) by denying coverage of a teen’s stay in a residential treatment facility because it didn’t fairly consider the repeated recommendations of her treating physicians and extensive evidence in the medical record that she needed longer term care.
