Supreme Court Lets Stand Ruling Against United over Denial of Residential Treatment Coverage

The U.S. Supreme Court refused February 20 to review a Tenth Circuit decision upholding a finding that United Behavioral Health violated the Employee Retirement Income Security Act (ERISA) by denying coverage of a teen’s stay in a residential treatment facility because it didn’t fairly consider the repeated recommendations of her treating physicians and extensive evidence in the medical record that she needed longer term care.
