Administration Ends Appeal of Decision Striking Rule Allowing Insurers to Exclude Copay Assistance from ACA Cost-Sharing Cap

The Department of Justice moved January 16 to dismiss its appeal of a district court decision that set aside a final rule giving health insurers the option of whether to count drug manufacturer copay assistance toward the Affordable Care Act’s (ACA’s) cap on annual cost-sharing for patients.
