U.S. Court in West Virginia Dismisses FCA Whistleblower Action Alleging Stark, AKS Violations

The U.S. District Court for the Southern District of West Virginia dismissed November 8 a whistleblower action against defendants Charleston Hospital, Inc., Herbert J. Thomas Memorial Hospital Association, THS Physicians Partners, Inc., Thomas Health System, Inc., and Brian Ulery based on alleged Stark Law and Anti-Kickback Statute (AKS) violations.
