Second Circuit Rejects MSP Action Against No-Fault Insurer for Lack of Standing

A no-fault insurer does not have to face claims for double damages under the Medicare Secondary Payer (MSP) Act that it deliberately and systematically failed to satisfy its reimbursement obligations to Medicare Advantage Organizations (MAOs), the Second Circuit held April 19.
